1. The general terms and conditions of sale published herein regulate the sales contract (hereinafter referred to as the “Contract”) entered into with users of the Website (hereinafter referred to as the “Buyers” or the “Buyer”) through electronic means for the goods (hereinafter referred to as the “Good” or “Goods”) displayed on the website www.frasette.com (hereinafter referred to as the “Website”), operated by Frasette di Francesca Fasano – located at Via Papa Giovanni XXIII, 170 – 73919 Trepuzzi (LE), VAT number 04790970752 (hereinafter referred to as “Frasette”).
2. The General Terms and Conditions of Sale published on the Website must be reviewed and acknowledged by the Buyer before purchasing any Good, and by submitting the purchase order, the Buyer declares that they have reviewed and accepted them.
3. Buyers will also benefit from the protections provided for distance contracts under Title III, Section II, of Legislative Decree No. 206 of September 6, 2005 (“Consumer Code”), as well as all other mandatory protections provided in favor of Buyers by the same Consumer Code http://www.codicedelconsumo.it/.
4. The sections “Shipping and Delivery,” “Returns and Exchanges,” and “Payment” available on the Website should be considered an integral and substantive part of these General Terms and Conditions of Sale.
2. Conclusion of the Contract
1. To purchase the Goods, the Buyer must submit their purchase order and make payment, following the procedures outlined in the respective sections of the Website.
2. In particular, the steps for completing the purchase are as follows:
a. The Buyer can freely access the Website and view the essential characteristics of the Goods displayed, including the price and images published to illustrate the Goods.
b. The Buyer can select one or more Goods they intend to purchase and place them in a virtual “cart.” The contents of the cart can always be viewed by the Buyer before submitting the order; furthermore, by accessing the cart, the Buyer can view all purchase details, including shipping costs and estimated delivery times, before making the purchase and payment.
c. To make a purchase, the Buyer must register on the Website by providing their email address and a password of their choice, which will allow them to access the Website.
d. To complete the order, the Buyer must also enter the shipping address and the payment details in the “cart” section.
e. The Buyer can modify the selected Goods and entered data until the final submission of the order, which must be confirmed by clicking the “Payment” button.

4. Once the purchase order is received, Frasette will send a confirmation receipt to the Buyer’s email address containing a summary of the purchase details and will proceed to fulfill the order. The order will be considered accepted, and consequently, the Contract will be deemed concluded when the Buyer receives the order confirmation via email.
5. The contract will be archived as a PDF and sent via email, while a digital copy will be stored electronically by Frasette.
3. Rights and Obligations of the Parties
1. Frasette will deliver the Goods to the address provided by the Buyer in the purchase order through a designated courier. More detailed information regarding delivery times, costs, and locations can be found in the “Shipping and Delivery” section of the Website.
2. Frasette assumes no responsibility for delivery errors due to inaccuracies or incomplete details provided in the purchase order by the Buyer, nor for any damages to the Goods after their delivery to the courier, delays caused by the courier, weather conditions, international customs issues, or other circumstances beyond Frasette’s control.
3. If one or more Goods are unavailable, Frasette will notify the Buyer via email sent to the address provided during registration. In such cases:
Frasette will refund the Buyer for the price and, where the purchase involved only the unavailable Good, the shipping costs, through a credit issued to the payment card or account used for the purchase.
With the Buyer’s consent, Frasette may send a substitute Good of equivalent value.
3.4. Should Frasette decide to make changes during production and/or refrain from producing one or more products, or if there are variations or a pre-ordered product is not subsequently manufactured for any reason:
Frasette will contact the Buyer to request express approval and proceed with the shipment or cancel the order and issue a refund.
3.5. In any case, the unavailability of one or more ordered Goods will not constitute grounds for the Buyer to cancel the entire order.
3.6. Upon delivery of the Goods by the courier, the Buyer must verify in the courier’s presence:
That the packaging used for transport is intact and not damaged or altered, including the closure materials.
That the quantity and type of Goods match those indicated on the delivery note and the order.
3.7. If the Buyer detects any anomalies or discrepancies, they must immediately notify the courier upon delivery of the Goods.
3.8. The Buyer is solely responsible for the accuracy and correctness of the information and data provided to Frasette and undertakes to promptly communicate any changes to the data previously provided.
4.Compliance of Goods
Frasette undertakes to ensure that the description and/or photographic representation of the Goods on the Website is as accurate as possible in relation to the actual Goods. However, considering that the quality of images may depend on the computer tools used by the Buyer, it is possible that the Buyer’s perception of the description or photographic representation of the Goods does not exactly match the actual Goods. As a result, the images and videos accompanying the presentation of the Goods on the Website should be considered as published for descriptive purposes only.
If the delivered Good is found to be defective or different from the one ordered, Frasette commits to providing the Buyer with a legal warranty of conformity, to be exercised under the conditions and terms set forth in Articles 128 and following of Legislative Decree No. 206/2005. Specifically, the Buyer will have the right to request, as an alternative:
a.The delivery of a Good identical to the one ordered, subject to stock availability;
b.The delivery of a Good of equivalent quality and price, subject to stock availability;A refund of the price of the Good and the shipping costs.
c.A refund of the price of the Good and the shipping costs.
3.The warranty provided under this article will apply only if the Goods have been handled with due care and in accordance with their intended use, and upon presentation by the Buyer of the delivery note received and the order number.
4.In any case, the warranty under this article will not apply to defects resulting from the normal wear and tear of the Good.
5.Withdrawal
1.In accordance with the provisions of the Consumer Code, the Buyer has the right to withdraw from the Contract, without paying penalties and without needing to specify the reasons, starting from the receipt of the order confirmation sent by Frasette and within fourteen working days from the receipt of the Good.
2.If the Buyer wishes to exercise this right of withdrawal, they must send an appropriate communication to Frasette within the aforementioned 14 working days from the delivery date of the Good.
3.In the event of exercising the right of withdrawal, the Buyer is also required to return the Good to Frasette no later than two weeks from the date of sending the aforementioned communication.
4.More detailed information regarding the procedure and instructions to follow for exercising the right of withdrawal, as well as related costs, can be found in the “Returns and Exchanges” section of the Website.
5.A fundamental condition for exercising the right of withdrawal is the substantial integrity of the product to be returned. However, it is sufficient for the Good to be returned in a normal state of preservation, as it has been stored and possibly handled with ordinary care.
In particular, the Goods must be returned:
a.Properly packaged in their original packaging, in perfect resale condition (not damaged, spoiled, or dirty) and accompanied by all accessories and documentation, if any;
b.Accompanied by the delivery document (included in the original packaging) to allow Frasette to identify the Buyer (Order number, first name, last name, and address);
c.Without obvious signs of use, except those compatible with a normal inspection of the item. Specifically, they must not show evidence of prolonged use (beyond a few minutes) exceeding the time necessary for an initial test and must not be in a condition that prevents resale.
7.The costs of returning the Good will be borne by the Buyer, as further detailed in the “Returns and Exchanges” section of the Website.
8.Following the Buyer’s exercise of the right of withdrawal in accordance with these General Terms and Conditions of Sale, Frasette will refund the amounts paid by the Buyer by crediting the payment card or bank account indicated for the purchase. The refund will be made within 14 days from the date on which Frasette becomes aware of the Buyer’s exercise of the right of withdrawal.
9.If the Buyer fails to comply with the conditions outlined in Articles 5.5 and 5.6, the Seller reserves the right to deduct from the refund an amount corresponding to the diminished value of the returned Goods, providing appropriate notice to the Buyer. Following such notice, the Buyer retains the option to recover the products, at their own expense, in the condition in which they were returned to the Seller.
10.The right of withdrawal, in any case, shall not apply to the following Goods:
a.Customized Goods;
b.Goods whose value has been diminished due to handling other than what is necessary to establish their nature, characteristics, and functioning.
11.If customers wish to return merchandise, they are kindly requested to complete the following Withdrawal Form and send it either via email to customerservice@frasette.com or by mail to the company address to request a return authorization number. The written request must include the order number, the code(s) of the item(s) to be returned, and the reason for the return: refund or exchange for a different size and/or color.
6.Personal Data Protection
1.Frasette is committed to respecting the confidentiality of personal data collected during registration on the Site and/or provided at the time of purchase by the Buyer and to processing them in accordance with the provisions of Legislative Decree No. 196/03.

7.Miscellaneous
1.Frasette reserves the right to modify these General Terms and Conditions of Sale at any time.
2.The General Terms and Conditions of Sale applicable to the sale of each Product will be those published on the Site at the date of the order for that Product. The Buyer, therefore, must review and accept these General Terms and Conditions of Sale before proceeding with any purchase.
3.If any provision of these General Terms and Conditions of Sale is considered null or invalid, the remaining provisions will remain valid and effective.
4.The mere tolerance or failure to contest any non-fulfillment by the Buyer regarding the contents of the General Terms and Conditions of Sale cannot be interpreted as tacit acceptance of such non-fulfillments, nor as an intention to waive the terms agreed upon by the parties.

9.Applicable Law and Dispute Resolution:
1.These General Terms and Conditions of Sale are governed by Italian law and, therefore, will be interpreted and enforced in accordance with it.
2.In case of service disruption or a dispute between Frasette and our user/customer, we guarantee our participation in an attempt at amicable reconciliation, which the user may initiate before RisolviOnline, an independent and institutional service provided by the Arbitration Chamber of Milan Chamber of Commerce. This service allows for reaching a satisfactory agreement with the help of a neutral and competent conciliator, in a friendly and secure manner.
3.In the event of disputes in consumer relations, pursuant to Article 66-bis of Legislative Decree No. 206/2005 (Consumer Code), the competent court is, without exception, that of the consumer’s place of residence (or domicile). Additionally, consumers established in Europe may use the platform provided by the European Commission for resolving any disputes arising from the online contract concluded on the website. The Right of Withdrawal is considered correctly exercised if the following conditions are fully met:
a. The Return Form and the security seal must still be intact and attached to the returned items. They must not be removed or cut in any way.
b. The items must not have been worn, washed, or altered in any way and must show no signs of use. The bags must be in perfect condition and must not be marked in any way.
c. The items must be returned with all original labels, packaging, and other accessories (bags, pendants, etc.) received with the order, and the returned products must be delivered to the carrier within fourteen (14) days from the date you communicated your decision to withdraw from the contract to Frasette.
The shipping costs for returning items purchased on this site are the responsibility of the customer.
Any customs duties are always the responsibility of the customer.
Frasette recommends that all returns be shipped using the DHL courier and the codes provided by our customer service. If you choose to use another courier, you will be responsible for all transport costs, and there will be an additional charge of 10% of the total value of the returned goods.
